Read this before publishing. Section 5 below (Foreign Contributions) is the single most legally sensitive clause on your entire website. Do not enable international payments on your Donate page until you have confirmed your current FCRA registration status with a professional and edited that section to reflect it accurately. Publishing a false or misleading FCRA claim is a serious compliance risk, not just a wording issue.

1. Acceptance of Terms

By accessing this website or making a donation through it, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use this website.

2. About Sutra Foundation

Sutra Foundation is a non-profit organisation registered under [Societies Registration Act 1860 / Trust Deed / Section 8 Company – specify], registration no. [INSERT], with 12A registration no. 3. Donations — General

  • Donations made through this website are voluntary contributions and, once processed successfully, are generally non-refundable, except in cases of duplicate charges, technical error, or payment gateway failure, at our sole discretion.
  • Refund requests for genuine payment errors must be raised within [7/14 – specify] days of the transaction, with proof of payment, by contacting info@sutrafoundation.org.
  • Tax exemption receipts under Section 80G will be issued only where valid PAN details are provided, and only to the extent permitted under our current 80G registration.
  • We use [Razorpay / specify] as our payment gateway. We are not responsible for delays, failures, or errors caused by the payment gateway, your bank, or your card network.

4. Domestic (Indian) Donations

Donations from Indian residents, in Indian Rupees, from an Indian bank account, card, or UPI ID, are accepted subject to Section 3 above. These are not treated as “foreign contribution” under Indian law.

5. Foreign Contributions — Important Notice

Under the Foreign Contribution (Regulation) Act, 2010 (“FCRA”), an Indian non-profit organisation may accept a donation, article, or currency from a foreign source, including from a Non-Resident Indian donating in foreign currency, or a foreign national, company, or organisation, only if it holds valid FCRA registration or prior permission from the Ministry of Home Affairs, Government of India, and only into a specifically designated FCRA bank account. This requirement is separate from, and in addition to, general foreign exchange rules under the Foreign Exchange Management Act, 1999 (FEMA).

Option A — if FCRA registered: “Sutra Foundation holds FCRA registration no. [INSERT], valid from [DATE] to [DATE]. Foreign contributions are accepted only into our designated FCRA account at [State Bank of India, New Delhi Main Branch] and are utilised strictly in accordance with the terms of our registration.”

Option B — if NOT currently FCRA registered: “Sutra Foundation does not currently hold FCRA registration or prior permission and is therefore not legally permitted to accept foreign contributions at this time. We are only able to accept donations from Indian residents, in Indian Rupees, from an Indian-issued payment method. We do not accept donations from foreign sources, including NRIs remitting in foreign currency, until such registration is obtained.”

If Option B applies to you, your Donate page must not offer an international payment option, and any such option should be geo-restricted or removed until FCRA registration is secured.

6. Website Use

You agree not to use this website for any unlawful purpose, to attempt unauthorised access to our systems, to upload malicious code, or to misrepresent your identity when making a donation or submitting a form.

7. Intellectual Property

All content on this website, including text, photographs, and the Sutra Foundation name and logo, is owned by or licensed to Sutra Foundation and may not be reproduced without prior written permission, except for personal, non-commercial reference.

8. Third-Party Links and Services

This website may link to or use third-party services (payment gateways, social media platforms). We are not responsible for the content, security, or practices of third-party websites or services.

9. Limitation of Liability

To the maximum extent permitted by law, Sutra Foundation shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or a donation made through it, beyond the amount of the transaction in question.

10. Governing Law and Jurisdiction

These terms are governed by the laws of India. Any dispute arising from these terms or your use of this website shall be subject to the exclusive jurisdiction of the courts at Delhi, India.

11. Changes to These Terms

We may revise these terms from time to time. Continued use of this website after changes are posted constitutes acceptance of the revised terms.
